Official Rules -My Kids and Their Pets Holiday – Photo Contest – December 2018
You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
PARTICIPATION DATES & PROMOTION STRUCTURE: Contest begins December 13, 2018 at 12:01 AM Eastern Time (“ET”) and ends December 31, 2018 at 11:59 PM ET (“Submission Period”). The Submission Period will be followed by a 5 day voting period starting at 8:00 AM ET on January 1, 2019 and ending at 11:59 PM ET on January 5, 2019 (“Voting Period”). Five winners including (1) overall winner will be selected at the end of the Contest from among all eligible Submissions received during the Submission Period.
WHO MAY PARTICIPATE: Contest is open only to legal residents of the fifty (50) United States and the District of Columbia.
HOW TO PARTICIPATE:
Non-Members: The one-time Entry Fee for the Contest is $4.99 – You may submit one photo from the date of registration to the end of the contest entry period.
Active My Photo Contest Monthly Members: The contest entry fee for this contest is not covered as part of your $19.95 Monthly Membership.
Before entering the Contest, participants must first pay the required entry fee by visiting the contest https://www.myphotocontests.com/my-kids-and-their-pets-holiday-photo-contest/
(the “Website”) After registering, follow the instructions and enter the Contest as outlined below:
Upon receipt of your registration payment, you will be provided with a access to the contest page where you can upload and submit your photo(s). If using mobile devices, data rates may apply. You will be charged according to your mobile device service provider’s rate plans. Please consult your mobile device service provider regarding rate plans.
Follow the instructions to upload a photo that complies with the contest theme and submit all required information on the registration form (the registration form and photo shall hereinafter collectively be referred to as the “Submission”). All Submissions must be made before the end of the Submission Period. All submissions will be moderated and approved by My Photo Contests prior to appearing in the Contest Gallery, moderation could take up to 24 hours depending on submission time, quantity of submissions etc. Once a Submission is made, you will not be permitted to change that Submission; however, if any Submission is invalid, participant will receive an email within three (3) days advising that his/her invalid submission was disqualified and he/she may attempt to enter again if time permits. All Entry Fees for ineligible or disqualified entries will be refunded.
By uploading a Submission, you consent to receiving emails from Promoter and/or its licensees and assignee’s.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If an eligible winner cannot be found for the prize, that prize will not be awarded.
MacFlin Properties LLC reserves the right to substitute any prize with another prize of equal or greater value.
Employees of MacFlin Properties LLC, and their immediate family members are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest judges, which are final on all matters pertaining to the contest.
Entrants further grant to MacFlin Properties LLC the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
MacFlin Properties LLC reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes for contests or other businesses operated by MacFlin Properties LLC unless prohibited by law.
The Contest and all of the related pages, contents are copyright protected MacFlin Properties LLC. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release any and all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
MacFlin Properties LLC is not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
Unacceptable Content
MacFlin Properties LLC reserves the right, in its sole discretion, to disqualify any entry:
Submission may not contain, as determined by the Promoter, in its sole discretion, any content that:
- Includes any subject matter that is not in conformance with the contest theme.
- Includes any child who is not appropriately dressed. All children, regardless of age, must be clothed on bottom. All children over twenty-four (24) months of age must also be clothed on top. No naked children or children in bath tubs or children in just a diaper will be eligible or accepted;
- That contains personally identifiable visual information about You or any other person.
- That contains threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content.
- That contains any material that could constitute or encourage conduct which would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
You agree to fully indemnify MacFlin Properties LLC and its sponsors in respect of all costs owing to any person or entity arising by reason of Your breaching any of the foregoing.
Copyright and Permissions
By submitting works to this contest you confirm that for each work submitted:
- You alone are the author of your work and that it is your original work.
- You are the sole copyright holder.
- You have not licensed any rights in the work that conflict with the usage rights required by MacFlin Properties LLC.
- You have the permission of any persons in the work, or if they are under 16, the consent of their parent or guardian, to grant the usage rights required by MacFlin Properties LLC.
- That it does not include trademarks, contract rights, or any other intellectual property rights of any other third person or entity.
- That it does not contain names, likenesses, or other characteristics identifying celebrities or other public figures, living or dead.
- You will be responsible for any claim made by any third party in respect of Your entry and to fully indemnify MacFlin Properties and its sponsors in respect of all royalties, fees and any other monies owing to any person or entity by reason of Your breaching any of the foregoing.
MacFlin Properties LLC reserves the right, in its sole discretion, to disqualify any entry that does not comply with any of the above, even after the entry is submitted on the competition website.
DCMA Notification to Remove or Disable Access to Copyrighted Content
My Photo Contests respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement or are aware of any infringing material placed by any third party on the My Photo Contests Website, please contact our designated copyright agent, in writing, either by email at: support@myphotocontests.com or by regular mail at Macflin Properties LLC, 4 Crane Ave Lewes DE 19958 Attn: Copyright Agent, and provide the designated copyright agent with information consistent with the form required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. How Winners are Selected.
Winners for each contest are selected based the judging criteria defined on each contest entry form, but may include a Public Voting Process, Juried Selection, or a Combination of the Public Voting Process and Juried Selection.
The My – Cute-Baby- Photo Contest for December 2018 winners will be determined by
The Voting Process.
- Public Voting Process –Eligible submissions made during the submission period will be displayed as voting-eligible photos on the Website during the Voting Period. During the Voting Period, individuals will be invited to visit the website and follow the instructions provided to vote for their favorite Submission. Votes are limited to one (1) vote per hour per person. Votes received from any person in excess of the stated limitations during the Voting Period will be void, as will any votes received in violation of the Voting Terms. Participants are prohibited from obtaining votes by any fraudulent or inappropriate means as determined by Promoter in its sole discretion, including, without limitation, offering prizes or other inducements to any person, creating or using multiple accounts for the primary purpose of circumventing voting rules, or directly or indirectly using automated or improper means to submit votes or create accounts. Submissions may be disqualified if they are found to have benefited from votes submitted in violation of these Terms and Conditions or the Voting Terms. Promoter reserves the right to validate all votes received through any means determined by Promoter in its sole discretion. The five photo’s receiving the most valid votes will be designated as Contest Winners.
- The top five photos receiving the highest scores from the judges will receive awards. The photo scoring the highest score will be awarded first place, the second highest scoring photo will be awarded second place, the third highest score third place, the fourth highest score fourth place and the fifth highest score fifth place.
- Winners will be notified within 7 days of their award and prize by email.
- All prizes will be awarded to the person named on the entry.
- Winners and Theme Finalist images will be displayed on MyPhotoContests.com.
Award Money
Cash awards will be defined for each contest.
For the My-Cute-Baby-Photo Contest – December 2018 the awards will equal 50% of the total contest entry fees. The total contest entry fees for this contest equal the total of all $4.99 contest entrance fees paid to participate in this contest. The contest Awards will be distributed as follows.
- First Place Award = 20% of total entry fees
- Second Place Award = 12% of total entry fees
- Third Place Award = 8% of total entry fees
- Fourth Place Award = 5% of total entry fees
- Fifth Place Award = 5 % of total entry fees

All Awards will be transferred to winners via a Paypal account, no other means of payment will be considered. Any fees incurred during currency transfers may be deducted from the winning amount. All winners will be notified within 7 days of contest closing dates and will have 45 days to provide MacFlin Properties with a valid PayPal address for awards distribution. Multiple emails (weekly) will be sent to non-respondents and if after 45 days no response is provided that Individuals Award will be forfeited.
Non- Cash Prizes
Most of our non-cash prizes are available throughout the United States of America, if it is determined that they are not available to or at a winners primary location, or if the contestant has previously won the same non-cash prize from MyPhotoContests.com, alternative prize awards may be provided at the sole discretion of MyPhotoContests.com. Sponsor prizes are not required to be used by the winners if they do not have an interest or a need in the offering and they are non-transferable to a party other than the My Photo Contests winner.

Dates and deadlines will be posted on each contest announcement page and entry form.
Consent Agreement
By entering this contest You agree that any (winning or shortlisted) work You submit may be used by MacFlin Properties LLCs solely for marketing and promotional purposes of this contest or future contests and no other purpose, these uses include:
- Judging the competition
- Displaying the entries on the competition website
- Inclusion within any materials promoting the competition organized by MacFlin Properties LLC
You hereby grant MacFlin Properties LLC a non-exclusive, irrevocable license in each Entry throughout the world in all media for the uses described in above for 2 years following the date of announcement of the winners.
You acknowledge your responsibility for protecting your Entry against misuse by third parties. MacFlin Properties and its Partners can assume no responsibility and are not liable for any misuse of your work by third parties.
Although it is unlikely, should any uses of the work beyond those needed to promote the contest arise You will be contacted and given the opportunity to negotiate any such usage with the parties concerned independently of the competition.
Right to Cancel
MacFlin Properties LLC reserves the right to cancel a competition at its own discretion if not capable of continuing as planned for any reason beyond our control. If a competition is cancelled, we will refund the entry fee to all entrants for the cancelled competition and we will not reserve the right to use any of the submitted images.
Taxes and Laws
MacFlin Properties LLC contest participation is Void where prohibited. All Federal, State and Local Taxes associated with the receipt of any Award is solely the responsibility of the winner.

Paid Contests:
My Photo Contests will refund your contest entry fee if your request is received before the contest entry period is closed. Please note, refunds are only available for individual paid contests. No refunds will be provided for membership subscriptions or past contest entries.
How do I cancel my account?
Please contact our customer support, support@MyPhotoContests .com before the contest end date to request a full refund of the contest entry fee for paid contests or to cancel your paid subscription. Upon receipt of the refund request, the entry fee will be refunded, and the associated contest entry will be void and not eligible for any prizes for that contest. Upon receipt to cancel a paid membership or subscription, the membership will continue with full privileges until the date of the next automatic renewal at which time no payment will processed and the membership and all associated privileges
